This Agreement (the “Settlement Agreement”), is entered into by and between Publix Super Markets, Inc. (“Defendant” or “Publix”), and Amanda Ott, Bruce Bogach, and April White (the “Named Plaintiffs”), for themselves and on behalf of the current opt-in plaintiffs (together with the Named Plaintiffs, “Current Plaintiffs” or “Group 1” as defined below) for their weeks worked within the relevant period as a Department Manager or Assistant Department Manager at Publix that were compensated for hours worked over 40 in a workweek using a “fluctuating workweek” method for calculating overtime, and who worked over 40 hours in such a position in any workweek during the time periods in this Agreement (a “FWW Associate”), resulting in an offer of settlement as set forth below to a class of all other similarly situated FWW Associates who are not Current Plaintiffs (“Group 2” as defined below), in the case of Amanda L.
