successor to the Missoula Area Economic Development Corporation under the Revolving Fund Loan Program (as hereinafter defined), having its principal office at 110 East Broadway, 2nd Floor, Missoula, Montana 59802 (the “Lender” and, together with the Borrowers, the “Parties”), amends and restates the Loan Agreement among the Parties dated as of August 10, 2006, as amended by the First Amendment to the Loan Agreement dated as of January 25, 2007, the Second Amendment to the Loan Agreement dated as of August 20, 2007, the Third Amendment to the Loan Agreement dated as of December 22, 2008, and the Fourth Amendment to the Loan Agreement dated as of December 14, 2009 (the “Prior Agreement”). The Prior Agreement is amended and restated in its entirety by this Agreement.
