This Agreement establishes the understanding between the Employer and MFS Heritage Trust Company (“MFS”), as custodian of MFS Employer Sponsored §403(b) Mutual Fund Custodial Accounts (“MFS Accounts”) established by participants in the Employer’s §403(b) Plan (the “Plan”), to share information necessary for compliance with the final regulations under §403(b) of the Internal Revenue Code of 1986, as amended (the “Code”) (the “Regulations”).
