This Contract (the “Contract”) is made and entered into this day of August, 2017, by and between the City of Galveston (the “City”), a Texas home-rule municipality, and Kleen Supply Co., a Texas Corporation, located at 2428 Church, Galveston, Texas 77550. By entering into this Agreement, Company agrees that City is entering into this agreement in its governmental capacity, and not a proprietary one.
