This Agreement is made and entered into as of March 18, 2020 by and between the City of San Bernardino, a municipal corporation organized and operating under the laws of the State of California with its principal place of business at Vanir Tower, 290 North D Street, San Bernardino, CA 92401 (“City”), and Kimley-Horn and Associates, Inc., a North Carolina Corporation with its principal place of business at 3880 Lemon Street, Suite 420, Riverside, California 92501 (hereinafter referred to as “Consultant”). City and Consultant are hereinafter sometimes referred to individually as “Party” and collectively as the “Parties.”
