These Purchase Order Terms and Conditions (“Terms and Conditions”) are incorporated into each purchase order (“P.O.”) issued by Companhia Providência Indústria e Comércio e Berry Ltda. and/or Berry do Brasil (collectively "Berry") and any other company from the Berry Global Group located in the Brazil (“Berry”) (the P.O. and the Terms and Conditions are collectively referred to as the “Agreement”). Berry agrees to purchase, and the supplier identified in the P.O. (“Supplier”) agrees to sell, solely pursuant to these Terms and Conditions, the goods and/or services described in the P.O. (“Goods”). Supplier will be deemed to have accepted these Terms and Conditions once it accepts the P.O. or has unambiguous knowledge of these Terms and Conditions or expressly or tacitly accepted their application, regardless of their form, including access to the website of Berry Global Group.
