A subletting agreement is a document between a tenant who has a lease with the landlord and a sub-lease that agrees to rent the same property from the tenant. The period of subletting may not go beyond the end date of the original lease. The tenant is required to obtain the landlord's consent if the sub- tenant is prohibited. Subletting occurs when (1) the tenant wants to terminate the lease early, but is rejected by the landlord and instead rents out to the sub-lease before the lease expires; or (2) The tenant wants to stay on the property while renting a sub-tenant's room.
