Comparative conclusion German law allows for a wide range of contractual arrangements affecting the future estate that, taken together, may help families reach harmony in post-mortem financial ar- rangements. This includes: the inheritance contract, the inheritance renunciation contract and the contract regarding the future estate between the future statutory heirs (which may be a condition of the inheritance renunciation contract as well as other benefits). Polish law allows only for the second of these contracts, namely the inheritance renunciation contract (which may be under a condition (including a benefit) that fulfils before the death of the person after whom the party to the contract was to inherit the estate, so may not regard a future estate). At the same time, even the available options of German law will not always solve the problem of family conflicts if not properly utilised, as the judgment shows.
