WHEREAS the First Nations and the Government of Canada have settled certain specific claims alleging the unauthorized construction and operation of the structure at the outlet of Echo Lake in the Qu’Appelle Valley (the “Structure”) causing flooding of a portion of reserve lands on such terms and conditions as are set out in the Pasqua Flooding Claim Settlement Agreement and the Muscowpetung Saulteaux Flooding Claim Settlement Agreement, each dated for reference August 22, 2012 (the “Specific Claims”);
