INCENTIVES (the "AGREEMENT") is entered into by and between the CITY OF BAYTOWN, a home-rule municipal corporation of Harris and Chambers Counties, Texas, hereinafter referred to as the "CITY", and BUILD BAYTOWN I, LLC, a Texas limited liability company authorized to transact business in the State of Texas, hereinafter called "DEVELOPER". The CITY and DEVELOPER may be referred to jointly herein as the "Parties" and individually as a "Party."
