Contract Type FiledMay 5th, 2020This matter was initiated by a complaint filed with the United States against HealthSource Saginaw alleging a violation of title III of the Americans with Disabilities Act (ADA), 42 U.S.C. §§ 12181-12189, and its implementing regulation, 28 C.F.R. Part 36. Specifically, the Complainant, an adolescent minor who is deaf and uses sign language as his primary means of communication, alleges that HealthSource Saginaw failed to provide him with a qualified interpreter which was necessary to ensure effective communication while being treated at HealthSource Saginaw's outpatient psychiatric clinic. The Complainant further alleges that although he only reads English at a first grade reading level, HealthSource Saginaw's only effort to facilitate effective communication was to have his physician communicate with him via pen and paper.
