This Franchise Agreement Between the Town of Hideout and Utah Telecommunication Open Infrastructure Agency, Regarding Construction Access for Telecommunications Infrastructure (“Agreement”) is made this _ day of , 2019, by and between the Town of Hideout, a municipal subdivision of the State of Utah (“Hideout”) and Utah Telecommunication Open Infrastructure Agency, an interlocal entity and political subdivision of the State of Utah (“UTOPIA” or “Franchisee”) and for the purpose of granting to UTOPIA the non-exclusive right to install, operate and maintain a communications system in, on, over, upon, along, and across the public rights of way of the Town of Hideout, and for the purpose of identifying and prescribing certain rights, duties, terms, and conditions with respect thereto.
