(the “Agency”) releases and discharges and shall indemnify, defend and hold the City of Port Huron and all its employees, agents, officials, officers, departments, insurers, representatives and/or volunteers (collectively the “Released Parties”) harmless from all liability, causes of actions, claims, damages, personal injuries, death, costs, expenses and fees, including attorney fees, resulting, arising or any way connected to the equipment sold by the City of Port Huron to the Agency (the “Equipment”). The Agency waives all claims and causes of action against the Released Parties, known or unknown, that arise or may arise out of or are connected in any way to the Equipment. The release, discharge and waiver of liability provided for herein are continuing in nature and bind the Agency and Agency’s heirs, representatives, successors and assigns.
