This Data Processing Agreement including its Attachments (“DPA”) between Quantitative Medical Systems, Inc., d/b/a Constellation Kidney Group (“Supplier”) and the entity that receives any Supplier Products from Supplier (the “Customer”) pursuant to a written or electronic agreement which governs the provision of those Supplier Products (the “Agreement”) shall apply to the extent that (i) Supplier Processes Personal Data on behalf of the Customer, and (ii) either the Agreement expressly incorporates this DPA by reference or the parties sign this DPA.
