LumInsight® 2 Cloud Central Management System (“CMS”)License Agreement • January 26th, 2018 • California
This is a legal agreement (the “License”) between you (“you”) and Echelon Corporation (“Echelon”), and governs your license to Echelon’s cloud application and data hosting, remote configuration and monitoring, and notifications and alarming services known as the LumInsight 2 Cloud CMS, all as more particularly described on the product page of Echelon’s corporate website, and as may be amended by Echelon from time to time in its sole discretion (the “Product”). As a condition of this License, you agree to comply with the Cloud Service License (the “CSA”) and Echelon’s Sales Order Terms and Conditions, a copy of which was sent to you along with Echelon’s sales acknowledgement acceptance of your purchase of your order (the “Ts&Cs”). The CSA and Ts&Cs are incorporated by reference herein, and apply to this License to the extent not expressly inconsistent herewith.
