– the failure to comply with the delivery period is due to force majeure, i.e. an unforeseen event on which we have no influence and which we are not responsible for (e.g. official ac- tions and orders (irrespective if they are valid or invalid), fires, floods, storms, explosions or other natural disasters, disturbances of operation, labour disputes, strikes, lockouts). This shall also apply if force majeure occurs during an undue delay in delivery and if a supplier of us is affected by force majeure;
