THIS AGREEMENT is made and entered into by and between the Town of Fishers, Indiana, acting by and through its Town Council (“OWNER”) and Merrell Bros. (“CONTRACTOR”), concerning the project (“Project”) described more particularly in Appendix A which is attached hereto and incorporated herein by reference.
