This Business Associate Agreement (“Agreement”) is made effective as of the Effective Date, by and between Tellus and Customer (referred to in this Agreement as “Covered Entity”). Each of “Tellus” and “Customer” shall have the same meaning ascribed to them in the Terms of Use Agreement into which this Agreement is incorporated, and the “Effective Date” shall be the date of the Terms of Use Agreement. The terms of this Agreement can be found at www.4tellus.com/baa. Tellus and the Covered Entity are hereinafter individually referred to as “Party” or collectively as “Parties.” Capitalized terms used herein and not otherwise defined shall have the meaning set forth in the Terms of Use Agreement between Tellus and Covered Entity.
