This document governs the terms and conditions of use upon which licensee (as defined in the order form; Buyer) has obtained a subscription regarding the Mendix Platform through the UK Crown Commercial Services Digital Marketplace G-Cloud 13 by virtue of an order form issued under the G-Cloud 13 framework agreement. Siemens Industry Software Limited (as defined in the order form; Supplier) (“Mendix”) and licensee (“Customer”) shall herein be referred to each as a “Party” and collectively as the “Parties”. In consideration of the mutual promises and covenants contained in this Agreement, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows:
