This class action settlement agreement (“Settlement Agreement”) is entered into between and among, on one hand, Class Representative Mark Drust (the “Class Representative”), on his own behalf and, subject to Court approval, on behalf of all putative Class Members (as defined below), and, on the other hand, Defendant Southwest Research Institute (“Defendant,” and together with the Class Representative and Class Members, the “Settling Parties”), in consideration of the promises, covenants, and agreements herein described, and for other good and valuable consideration acknowledged by each of them to be satisfactory and adequate.
