and entered into as of the last date of execution below (the “Effective Date”) by and between Aqua Texas, Inc., a Texas corporation (“Aqua”) and RCH Water Supply Corporation, a Texas nonprofit water supply corporation created and operating pursuant to Chapter 67 of the Texas Water Code and Chapter 22 of the Texas Business Organizations Code (“RCH”). RCH and Aqua are individually referred to herein as a “Party” and collectively as the “Parties”.
