Ventures. Under these agreements and the Declaration, the Mortgaged Property may be used for certain purposes without further remediation, in accordance with the conditions of the VCC. However, certain restrictions are placed on development and use of the Mortgaged Property. The restrictions include (1) the Mortgaged Property shall not be used for: (i) stand-alone residential dwellings with yards; (ii) agricultural; (iii) recreational areas with potential exposure to surface soil; (iv) stand-alone child day care facilities with yards; (v) schools for a population of less than 18 years of age; or (vi) stand-alone elder care facilities with yards; (2) the groundwater beneath the Mortgaged Property may not be used for drinking or irrigation purposes without Department approval, (3) digging or other land disturbance activities shall be conducted in accordance with a Department-approved Soil Management Plan and (4) certain floors or slabs, land cover and landscaped areas shall be considered
