The Contractor performs claims management services on behalf of or for the Agency pursuant to the Underlying Agreement that requires the exchange of information about patients that is protected by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), as amended by Subtitle D of the Health Information Technology for Economic and Clinical Health Act, Title XIII of Division A and Title IV of Division B of the American Recovery and Reinvestment Act of 2009 (Pub. L. No. 111‐5) (the “HITECH Act”) and the federal regulations published at 45 C.F.R. parts 160 and 164 (collectively “HIPAA”). Pursuant to HIPAA and the Privacy Rule, PHI that Contractor will create, have access to and/or receive from KDHE may be used or disclosed only in accordance with this Agreement and the Privacy Rule. KDHE is a Covered Entity under HIPAA, and therefore Contractor is not permitted to use or disclose health information in ways that KDHE could not. This protection continues as long as the dat
