if that has been received from or on behalf of a party in whatever form, including (without limitation) any samples, Materials, compounds, data, reports, analyses, specifications, techniques, processes, technical information, ideas, Know-How, trade secrets, unpublished patent applications and inventions (whether or not patentable), drawings, designs and computer software. The information disclosed tangibly has to be marked as confidential at the time of such disclosure, or if disclosed orally, stated to be confidential at the time of such disclosure and confirmed as confidential in writing within 30 days after disclosure.
