BUSINESS ASSOCIATE AGREEMENTBusiness Associate Agreement • July 27th, 2022
This Business Associate Agreement (“BAA”) is entered into between PresenceLearning, Inc. (“Presence” or “Business Associate”) and the Customer accessing Presence’s Kanga platform (“Customer” or “Covered Entity”), and forms part of the Software-As-A-Service Agreement, Terms of Use, or any other agreement pertaining to the delivery of services (collectively, the “Service Agreement” as defined further below) between Presence and the Customer named in such Service Agreement to reflect the parties’ agreement with regard to the Processing of Protected Health Information (as defined below). This BAA will be effective as of the date Covered Entity accepted the terms herein (the “BAA Effective Date”). Presence’s liability arising out of or related to this BAA will be determined solely in accordance with the parties’ Service Agreement.
