This Design-Build Commercial Sales Contract (“Contract”) is entered into on the Effective Date by and between the CITY OF BURLESON, a Texas municipal corporation located in the counties of Johnson and Tarrant, State of Texas (“City” or “Buyer”), and BTX OLD TOWN, LLC, a Texas Limited Liability Company (“Builder” or “Seller”) for portions of buildings to be constructed on a plot of land to be platted in Block 13, Original Town of Burleson, City of Burleson, Johnson County, Texas, more particularly described in Exhibit “A” attached hereto and incorporated herein for all purposes (“Property”), and specific improvements to be constructed thereon (“Improvements). Buyer and Builder may be referred to herein individually as a party and collectively as the parties.
