SETTLEMENT AGREEMENT AND RELEASESettlement Agreement • January 22nd, 2020
This Settlement Agreement and Release (the “Agreement” or “Settlement”) is made by and between plaintiff Andrew Horton (“Plaintiff”) for himself and the Settlement Class (as defined below), on the one hand, and Navient Solutions, LLC (“NSL”), for itself and the Released Parties (as defined below), on the other hand. NSL, Class Counsel (as defined below) and Plaintiff hereby stipulate and agree that, in consideration of the promises and covenants set forth in this Agreement and upon entry by the Court (as defined below) of a Final Approval Order (as defined below), all claims of Plaintiff and the Settlement Class Members (as defined below) in the action entitled Andrew Horton v. Navient Solutions, Inc., Commonwealth of Massachusetts, Suffolk County Superior Court (the “Court”), Civil Action No. 1784CV01855 (the “Action”), shall be settled, compromised and released upon the terms and conditions contained herein.
