These LINQ Terms and Conditions (“Agreement”) set forth the provisions under which Hill-Rom Company, Inc. and/or its corporate affiliates (“Hill-Rom”) grants to Customer certain licenses to use and/or install, as applicable, the LINQ software applications (each a “LINQ Application”). As used throughout this Agreement, “Software” means the LINQ Application(s) specified on Customer’s Proposal, which includes Hill-Rom proprietary software (including updates and/or upgrades thereto) and all third party software that Hill-Rom may have purchased, licensed, or otherwise acquired from third parties and delivered to Customer as part of the LINQ Application.
