The Prospective Purchaser Agreement would resolve certain potential EPA claims under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended by the Superfund Amendments and Reauthorization Act of 1986 (‘‘CERCLA’’), and potential claims under section 3008(h) of the Resource Conservation and Recovery Act (‘‘RCRA’’).
