Notwithstanding anything to the contrary in the Agreement, if any Product consists of Software, such Software is licensed pursuant to the terms of the End User license agreement (“EULA”) included with the Product or its documentation (either in shrink-wrap, click-wrap or other form). If no EULA is included with a Software Product or its documentation, then such Software is licensed pursuant to the terms of the EULA set forth below. Except where the EULA for a Software Product is a click wrap or shrink wrap license, Distributor will (i) ensure that its sales to End Users of such Software Products are subject to the terms of the EULA and a copy thereof is delivered to and signed by the End User and (ii) Distributor will retain a copy of the End User-signed EULA and provide a copy to CCS Care Communication Solutions GmbH upon request. CCS Care Communication Solutions GmbH may provide the Distributor with an updated version of the EULA from time to time in CCS Care Communication Solutions
