WHEREAS, Tilcon New York, Inc. and the Township of Wayne have heretofore entered into an Agreement, more particularly known as Contract No. 630, “2011 Road Resurfacing Program,” dated August 4, 2011, for the furnishing of labor, equipment and materials in the amount of $2,289,862.00, in accordance with the requirements of the Local Public Contract Law, N.J.S.A. 40A:11-1, et seq.; and
