This Settlement Agreement, Release of Claims, and Covenant Not to Sue (“Agreement”) is entered into this _ day of , 20 , by and between BK Properties, whose mailing address is PO Box 2052, Minot, North Dakota, 58702, (“BK Properties”), and the City of Minot, North Dakota, a political subdivision, (“City”). The City and BK Properties are referred to collectively in this agreement as the “Settling Parties.”
