This First Amendment to the Tax Abatement Agreement (this “Amendment”) is made and entered into by and between Western Texas College (“College”), acting by and through its duly elected officers, and Canyon Wind Farm, LLC, a Delaware limited liability company (“Owner”) to amend the Tax Abatement Agreement entered into between College and Owner dated on or about September 10, 2018 (“Agreement”). Undefined capitalized terms herein shall have the meaning ascribed to them in the Agreement.
