This Land Exchange Agreement (“Agreement”) is made and effective as of the date of execution (“Effective Date”) of the last signing party below, by and between Milton L. Talcott, Trustee of the Milton L. Talcott Revocable Trust, and Carol A. Talcott, Trustee of the Carol A. Talcott Revocable Trust (collectively “Talcott”); the R. C. Krueger Development Company, a Nebraska corporation (“Krueger”); and the City of Lincoln, Nebraska, a municipal corporation and political subdivision of the State of Nebraska (“City”). Talcott and Krueger are collectively referred to herein as “Owner”.
