The terms set forth in this Third Party Terms agreement (the “Third Party Terms”) apply to any third party products (including applications and application templates) (the “Third Party Products”) licensed by you (“You”) through VMware Horizon™ Cloud Service® with Hosted Infrastructure (the “Service Offering”). For purposes of these Third Party Terms, “VMware” means VMware, Inc., a Delaware corporation, if the billing address for your Order is in the United States, and VMware International Limited, a company organized and existing under the laws of Ireland, if the billing address for your Order is elsewhere. The Third Party Terms are subject to the Terms of Service (the “Terms of Service”) presented with the Service Offering. The Third Party Terms supersede and control over any conflicting terms and conditions in the Terms of Service, any order document, acknowledgment or confirmation, or other document issued by You, unless VMware executes a written agreement with You expressly providi
