is entered into by and among Dow Corning Corporation, a Michigan corporation (“Dow Corning”), the Domestic Health Insurers which have, or pursuant to the Plan (as defined herein) are deemed to have, executed this Agreement (the “Settling Health Insurers”), pursuant to the Amended Joint Plan of Reorganization (the “Plan”) dated as of February 4, 1999 in case number 95-20512 in the United States Bankruptcy Court for the Eastern District of Michigan, Northern Division (the “Court”). Certain of the Settling Health Insurers are parties to this Agreement in both their individual and representative capacities as administrators or representatives of certain self-funded health care plans and/or other entities or affiliates.
