THIS SETTLEMENT AGREEMENT (the “Agreement”) is made and entered into as of this day of April, 2021, by and among: (1) David J. Owens, individually and as trustee of The David J. Owens Revocable Living Trust, Dated December 15, 2008 (collectively “Owens”); (2) David J. West, individually and as trustee of the West Revocable Trust, Established July 10, 1998 (collectively “West”); (3) Verde Glen Property Owners Associations, an Arizona non-profit corporation (“VGPOA”); (4) Verde Glen Water Company, an unincorporated business (“VGWC”); and (5) Don Ascoli and Anne Ascoli, husband and wife (collectively the “Ascolis”). VGPOA, VGWC, and the Ascolis are sometimes collectively referred to as the “Defendants.”
