Pursuant to Rules 212 and 713 of the Federal Energy Regulatory Commission’s (“Commission” or “FERC”) Rules of Practice and Procedure, 18 C.F.R. §§ 385.212, 713, and section 313 of the Federal Power Act (“FPA”), 16 U.S.C. § 825l(a), Southwest Power Pool, Inc. (“SPP”) submits this request for rehearing of the Commission’s December 19, 2008 order regarding the delegation agreement between the North American Electric Reliability Corporation (“NERC”) and the SPP Regional Entity.1 SPP seeks rehearing of the Commission’s directive that the SPP Regional Entity must pay all of its statutory expenses out of the separately maintained account for the Regional Entity rather than reimbursing SPP for shared expenses.2
