The Agency's store agreement is a type of collective agreement under which trade union membership remains optional with the employee. Union membership is neither compulsory nor unavailable, but the employee as a condition of employment is obliged to pay union initiation fees and regular fees. An agency shop is a workplace where, even if workers do not join the union, they still have to pay the equivalent of taxes to the union. In collective agreements with an agency store provision, non-members of a trade union are required to pay the membership fee or a representation fee for contractual negotiations, administration, and complaint processing. Payment of membership or representation fees often becomes a condition of employment, and those who refuse to pay are subject to discharge. Employee organisations argue that, in accordance with the law, the exclusive bargaining agent must represent all employees in the unit, whether or not they are union members.
