The provision by Daimler Truck AG (“Daimler”), or one of its affiliated companies (para 15 sqq. of the German Stock Corporation Act (AktG)), of digital certificates with respective associated private key to access control devices (“DCS- T Certificates”) is exclusively subject to the following terms and conditions. Any general terms and conditions of the company intending to use DCS-T Certificates (the “User”) are not part of the Agreement, even if these are included with calls for tenders, orders, or declarations of acceptance and no objection was raised to them.
