THIS MASTER SOFTWARE AS A SERVICE SUBSCRIPTION AGREEMENT, dated as of the date of Customer’s purchase of the use of the Licensed Software, between Apilayer Data Products GmbH, a company organized under the laws of the Republic of Austria (“Apilayer”), and the customer set forth on the purchase order pursuant to which the subscription licenses for the Licensed Software were purchased (“Customer”), sets forth the terms and conditions whereby Apilayer agrees to provide to Customer for a limited period of time and Customer agrees to acquire from Apilayer one or more limited subscription licenses to access and use certain software and documentation and maintenance services related thereto, owned or licensed by Apilayer or a subsidiary or an affiliate of Apilayer, as set forth on the Purchase Order (as defined below), which shall be delivered by Apilayer as a hosted service.
