NOW THEREFORE in consideration of the City's agreement to enter in the ENRA and for other good and valuable consideration, receipt of which is hereby acknowledged, and the mutual promises set forth below, the City and Developer (individually a "Party" and collectively, the "Parties") agree as follows:
