This Contract (hereinafter referred to as “Contract”) is made and entered into effective as of the date executed in full May 14, 2019 by City of Wichita, located at 455 N. Main, Wichita KS 67202 and Proterra Inc, a Delaware corporation, with its principal place of business 1 Whitlee Court, Greenville, SC 29607 (“Contractor”) for the manufacture and delivery of (4) 35-Foot Proterra Catalyst Battery Electric Buses (hereinafter “Buses”), and (4) Depot Charging Station(s) (hereinafter “Depot Charging Station”). The City of Wichita] and the Contractor are sometimes individually referred to as “Party” and collectively as “Parties.”
