, 2011 (the "Execution Date") by and between THE HUNT CLUB COMMUNITY ASSOCIATION, a non-profit mutual benefit corporation organized and existing under the laws of the State of California ("Hunt Club"), the City of San Juan Capistrano ("City") and the STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION, a governmental department with the State of California ("Caltrans"). This Agreement shall become effective upon its approval by the Orange County Superior Court, and its incorporation in the judgment in the hereinafter described Lawsuit, in accordance with Section Four below.‌‌‌‌
