This SoGware End User License Agreement (this “Agreement”) is entered into between Trimble Inc. or the Trimble affiliate identified on the applicable Order Form (“Trimble”) and you (“Customer” or “you”), the individual or entity that has downloaded or otherwise procured the SoGware (as defined below). This Agreement is effective on the earlier to occur of the date you first executed an Order Form, downloaded the SoGware or clicked to agree to this Agreement (“Effective Date”). This Agreement includes any Order Forms or exhibits which reference this Agreement and any applicable Product-Specific Terms.
