THIS SOLAR LEASE AND EASEMENT AGREEMENT (this “Agreement”) is made, dated and effective as of August 26, 2019 (the “Effective Date”), by and between the City of Pueblo, a Colorado municipal corporation, (together with its successors, assigns and heirs, comprising “Owner”), and Grid Alternatives Colorado, Inc, a Delaware nonprofit corporation (together with its transferees, successors and assigns, “Grantee”), and in connection herewith, Owner and Grantee agree, covenant and contract as set forth in this Agreement. Owner and Grantee are sometimes referred to in this Agreement as a “Party” or collectively as the “Parties”.
