The Amended and Restated Disposition, Development and Owner Participation Agreement ("ARDDOPA") between the Sunnyvale Redevelopment Agency and RREEF/Sand Hill Property Company provides for the construction of the Town Center Project ("Project") in phases. Each of the phases of construction is eligible for a separate Certificate of Completion. To complete the property transfers between the Redevelopment Agency and the Developer required by the ARDDOPA, the Developer has submitted a final map which includes public improvement plans. The Developer is requesting to provide financial bonds or security for the public improvements for each phase of construction, as permitted by the ARDDOPA, rather than posting a single bond for the entire project prior to the commencement of all phases of the Project.
