The City of Jonestown is considering changing the way in which sewer service will be delivered to Phases IIC, IIIA, and The Bluffs of The Hollows Subdivision. The development agreement for those sections of The Hollows requires wastewater service to be provided by a wastewater treatment plant constructed by the developer. Wastewater service is currently provided to occupied lots through pump and haul, which is an interim wastewater service. This City is involved in two separate lawsuits related to these issues. In one of the lawsuits, Centex Homes disputes that it has an obligation to build a wastewater treatment plant. The successor developer, MDR Hollows, defaulted on its loans, and the unsold portions of The Hollows Subdivision are owned by one of MDR Hollows’s lenders.
