THIS DECLATION OF RESTRICTIVE COVENANTS (the "Declaration"), made, published, and declared this 5th day of January, 1995, by and between The Peninsula, a Tennessee general partnership composed of Dukes & Co., a Tennessee corporation', and Jerry Butler Construction, Inc., a Tennessee corporation (the "Developer"), and any and all persons, firms, or corporations presently owning or hereafter acquiring any of the within described property;
