This Exercise Facility Agreement (the “Agreement”), dated as of , 20__, (the Effective Date”) is entered into by and between The Peachtree Condominium Association, acting by and through its Manager, Banyan Street Capital LLC, whose address is 1355 Peachtree Street, Suite 101, Atlanta, GA 30309, and the undersigned (the “Member”) for the right or privilege to use the exercise facility, including the exercise equipment, improvements, furnishings, and fixtures therein situated, in the Lower Lobby of The Peachtree located at 1355 Peachtree Street, Atlanta, GA 30309 (collectively, the “Exercise Facility” or the “Facility”).
